A SUMMARY OF ENVIRONMENTAL LAWS FOR THE TOWN OF GREECE
THIS INFORMATION IS TO BE USED ONLY AS AN INFORMAL GUIDE TO THE VARIOUS
STATE, COUNTY, AND TOWN LAWS. ITS INTENT IS TO BE A QUICK REFERENCE OF
ENVIRONMENTAL LAWS AND TO PROVIDE A MEANS FOR RESIDENTS TO ASSIST THE
AGENCIES RESPONSIBLE FOR ENFORCING THEM.
WHEN REPORTING AN INCIDENT, THE MORE DETAILED THE DESCRIPTION (LICENSE NUMBERS, LOCATION, PHOTOGRAPHS, ETC.) THE EASIER ENFORCEMENT WILL BE. FOR MORE SPECIFIC INFORMATION, PLEASE CONTACT THE RESPECTIVE AGENCY.
- LAND
CONSERVATION AND PROTECTED LAND
Environmental Conservation Law 9-0303: No person may remove or destroy trees or enter conservation land with the intent to alter it in any way. Report violations to State Dept. of Environmental Conservation, Avon, 226-2466.
Town Dedicated Land: No person may litter, dump, excavate, or remove
trees from land dedicated to the Town (tree lawn area, natural streams, buffer
zones). Report violations to Town Police, 911 or Town Dept. of Public Works,
225-4590.
WETLANDS
Town Code, Chapter 120: No person may alter a freshwater wetland or adjacent buffer zone without a written permit from the State Dept. of Environmental Conservation, Avon, or the US Army Corps of Engineers, Buffalo. Report violations to: NYSDEC, 226-2466
or US Corps of Engineers, 879-4330.
EXCAVATIONS AND TOPSOIL REMOVAL
Town Code, Chapter 103: No excavation may be made or topsoil, earth, sand, gravel, or rock removed from the ground unless a permit is first obtained from the Town. Report violations to the Town Engineering Office, 723-2260.
LITTER
Town Code, Chapter 157: No person may deposit or throw any refuse, hazardous waste, or recyclable materials in a public right-of-way, street, or any property not owned by him. Report violations to
Town, 225-2000.
JUNKED MOTOR VEHICLES
Town Code, Chapter 157 & 198: No one may store unlicensed motor
vehicles outdoors. Report violations to Town, 225-2000.
SEWAGE
County Sanitary Code: No person shall maintain any sewage
disposal system so as to expose the contents to the atmosphere, or on the
surface of the ground, or into a storm drain, or so as to endanger any water
course or body of water. Visual signs, smell, or raw sewage, or other
violations should be reported to County Health Dept. 753-5060.
FILLING AND DUMPING
Town Code, Chapter 157: Nontoxic, inorganic material may be used as fill provided its use, composition, amount, location, and extent are permitted by the Town.
Filling with or dumping of organic materials,
chemical wastes, liquid petroleum derivatives, or other deleterious
substances shall not be permitted. Report violations to Town, 225-2000.
REFUSE
Town Code, Chapter 157:
- No person may accumulate refuse upon his property except for the purpose of collection.
- No person may deposit refuse on any property not owned or occupied by him.
- Recyclables must be prepared for collection according to guidelines provided by the private haulers and/or Monroe County.
- Recycling leaves, grass cycling, composting contact Town Public Works, 225-4590.
- Refuse receptacles must be watertight and shall be closed at all times with a tight fitting cover.
- Refuse for collection may not be placed at the curb before noon of the day preceding pickup.
- Household hazardous waste may not be placed for collection with other type of refuse (i.e. paint, gas, fertilizer).
- No place may be used as a landfill for dumping of refuse.
- Vehicles used to transport refuse must be covered
and leakproof.

- TREES
PRESERVATION OF TREES
Tree Ordinance, Town Code, Chapter 193: No person may remove trees from public rights-of-way or public land. No person may deposit or remove materials in such a way as to damage trees in public rights-of-way or public land. Report violations to Town Dept. of Public Works, 225-4590.
- WATER
FISH KILLS
Report violations to State Dept. of Environmental Conservation, Avon, 226-2466.
DISTURBANCE OF STREAM BEDS OR BANKS
Environmental Conservation Law 15-0501: No person may change the course of or remove sand or gravel from the bed or banks of any stream without having obtained a written permit. Report violations to State Dept. of Environmental Conservation, Avon, 226-2466.
DAMS AND DOCKS
Environmental Conservation Law 15-0503: No person may erect or repair any dam or dock without having obtained a written permit. Report violations to State Dept. of Environmental Conservation, Avon, 226-2466.
PIPE DISCHARGE
Discharge from any pipe which has a strong odor or which has foam, solid matter, an oil sheen, or which is discolored should be reported to Town Dept. of Public Works, 225-4590.
OIL DUMPING
Environmental Conservation Law 23-2308: No person may engage in the improper disposal of used oil. Used oil must be deposited only in a used oil retention facility (such as the Town's facility at the Dept. of Public Works, 225-4590.
HAZARDOUS MATERIAL SPILLS
Lake Ontario: Report violations to the US Coast Guard, 342-4140. All others:
Report violations to State Dept. of Environmental Conservation, Avon, 226-2466
or 1-800-424-8802.
EXCAVATION OR FILL IN NAVIGABLE OR ADJACENT WATERS
Environmental Conservation Law 15-0505: No person may excavate from or place fill in navigable waters or adjacent marshes/wetlands without having obtained a written permit. Report violations to State Dept. of Environmental Conservation, Avon, 226-2466.
DEBRIS DUMPING
Dumping of debris into town creeks and streams should be reported to Town,
225-2000.
LITTER
New York State Navigation Law Section 33-C: Prohibits throwing litter into any water body or onto adjoining public land within 100 ft. of a water body. Report violations to the US Coast Guard, 342-4149.
Federal Refuse Act of 1899: Prohibits the throwing of refuse of any kind into navigable waterways or their tributaries. Report violations to the US Army Corps of Engineers, Buffalo.

- VISUAL
SIGNS
Legal home occupations are permitted one freestanding or building mounted sign not to exceed 2 sq.ft. in size.
Educational, charitable, civic, and religious organizations are permitted one freestanding sign not to exceed 25 sq.ft.
Housing subdivisions and multiple family dwelling developments are permitted one freestanding entrance identification sign not to exceed 20 sq.ft. in size.
Model homes or the temporary location of a builder’s office in a dwelling in a subdivision are permitted one sign not to exceed 2 sq.ft. in size. Report violations to Town,
225-2000.
- NOISE
UNNECESSARY AND UNUSUAL NOISES
Town Code, Chapter 139: Prohibits any unreasonably loud or unnecessary
noise that disturbs the peace and quiet of the neighborhood. It also prohibits
the operation of any motor vehicle unless equipped with an adequate muffler
properly maintained and in constant operation. Report violations to Town Police, 911.
MINI-BIKES, SNOWMOBILES, ATVs JET SKIS
Town Code, Chapter 203: Prohibits the operation of a motor vehicle on private property without written permission from the property owner. Report violations to Town Police, 911.
- AIR
EMISSIONS
Monroe County Air Pollution Code: Limits smoke emissions, prohibits open fires, limits particulate and contaminant emissions. Report violations to County Health Department,
753-5550.
DIESEL EXHAUST
New York State Air Pollution Code, Part 218: A diesel-powered motor vehicle is not permitted to idle for more than 5 minutes when the vehicle is not in motion, except as may be required by traffic conditions. Report violations to Town Police, 911.
- HEALTH
BRUSH AND WEEDS
Town Code, Chapter 68 & 157: To prevent unhealthy, hazardous or
dangerous conditions, land owners may be required to cut, trim or remove brush,
grass, rubbish, or weeds, or to remove or destroy poisonous shrubs or weeds.
Report dangerous conditions to Town, 225-2000.
UNSAFE STRUCTURES
Town Code, Chapter 75: If in the opinion of the Town Board a structure or building is deemed unsafe and dangerous, the Board may order its removal or repair. Report dangerous structures to the Town,
225-2000.
PESTICIDES
Report the use of illegal pesticides to State Dept. of Environmental Conservation, Avon, 226-2466.
RODENTS
Report the presence of bothersome rodents to County Health Department, 753-5058.
STRAY CATS, DOGS
Report the presence of bothersome cats or dogs to Town Animal Control, 581-4025.
