Rental Property Permit
Permitting of Rental Properties and Short-term Rental Properties within the town are regulated by the Technical Services Department for the safety of the occupants and neighboring properties. The Technical Services Department performs interior inspections on registered Rental Properties every three years and annually on registered Short-term Rental Properties. Code Enforcement Officials inspect these properties in search of NYS Property Maintenance Code, NYS Residential Building Code, and NYS Fire Code violations. These officials ensure these properties are kept at the code standard.
A property upon which is located a building or buildings or structure or structures which include one or more rental dwelling units. (Town Code Section 162A-2)
Owners of Rental Properties can obtain a Rental Permit by completing and submitting the Rental Property Permit Application to the Technical Services Department. Once a permit has been obtained the permit holder must obtain a passing rental inspection within 90 days of the issuance of the permit. Once a passing inspection has taken place a Certificate of Compliance will be issued to the permit holder. This Certificate of Compliance is good for three years (from the issuance date of the rental permit). When a Rental Property Certificate of Compliance expires, the rental property falls into a state of non-compliance and a new Certificate of Compliance is required. It is the responsibility of the property owner to maintain an active Certificate of Compliance.
Short-term Rental Property
A property upon which is located a building or buildings or structure or structures which include one or more rental dwelling units, and one or more of the dwelling units is occupied or used by one or more persons other than the owner as a home or residence for a period of less than three months under an arrangement whereby the occupant or occupants thereof pay rent for such occupancy and use. Short-term rental properties include, but are not limited to, vacation rental homes and what are commonly referred to as "bed-and-breakfast" establishments. (Town Code Section 162A-2)
Owners of Short-term Rental Properties can obtain a Short-term Rental Permit by completing and submitting the Rental Property Permit Application to the Technical Services Department. Upon submission, the applicant must ensure the “Short-term Rental” box has been checked. Once the application has been approved and all applicable fees have been paid, both a Rental Property Permit and a Short-term Rental Property Permit will be issued. The permit holder must obtain a passing rental inspection within 90 days of the issuance of these permits. Once a passing inspection has taken place a Certificate of Compliance will be issued to the permit holder for both permits. A new Rental Property Certificate of Compliance must be obtained every three years. A new Short-term Rental Property Certificate of Compliance must be obtained annually.
While operating a Short-term Rental Property, the property owner must ensure the following is provided in a conspicuous location within the residence during all rental occupancies (Town Code Section 162A-7):
- Emergency Contact Information
- Name, address, phone number of property owner(s);
- Instructions on dialing 911 for emergency/fire/ambulance assistance

The property owner must also provide the names and permanent residence addresses of all expected tenants to the Technical Services Department. This information must be kept up to date.
